A government attorney today filed a chargesheet at Kathmandu District Court seeking 17-year jail term for lawmaker Shyam Sundar Gupta and his five accomplices who are in police custody on charges of kidnapping Pawan Kumar Sanghai, a businessman. The government attorney has also sought confiscation of Rs 8.5 million from the abductors.
The government attorney has sought 15 years in jail for Gupta and his associates for abducting Sanghai and taking him hostage at Kavre as per Section 3 of the Abduction and Hostage Taking Chapter of Muluki Ain, 1963, and two years additional term as per Section 7 of the Chapter to all the accused for ganging up to perpetrate the crime.
A handcuffed Gupta, a former minister and Constituent Assembly member from Nepal Sadbhawana Party (Anandidevi), was made to appear before court while registering the chargesheet today. Akash Lama of Deurali VDC, Kavre; Jit Bahadur Gole alias Bikas of Padam Pokhari, Makawanpur; Amir Acharya of Hetauda; Kishore Pandey of Kavresthali, Kathmandu and Bishnu Laxam (Feudin) alias Aarju Subba have been chargesheeted for working as Gupta’s accomplices.
The government has demanded that the court orders confiscation of Rs 8.5 million, the amount that was paid as ransom, from the accused, slap a fine of Rs 2 lakh on them as per Section 3 of the Chapter and provide Rs 500 compensation for each day for taking Sanghai hostage for 20 days as per Section 12 of the Chapter. Gupta and his accomplices had abducted Sanghai from Kathmandu on December 22. Gupta was arrested on January 16 in his hometown Bhairahawa.
The prosecutor in the chargesheet has mentioned Gupta as the mastermind of the crime. Gupta, who has denied charges against him, once again accused the ruling Unified CPN-Maoist and its coalition partner UDMF of implicating him. He even went on to allege that the media was putting pressure on court in relation to the case. He said mediapersons had gathered at the court today as per the directives from either Maoist Chairman Pushpa Kamal Dahal or NSP Chairperson Sarita Giri.
